California Prop 65

California Proposition 65 Notice

At Oliaskin, we believe transparency is an essential part of earning your trust. If you are shopping from California, you may notice a Proposition 65 warning on certain product pages, product labels, packaging, or during checkout.

California law requires businesses to provide a warning when a product may expose consumers to certain chemicals listed by the State of California, unless the anticipated exposure is below applicable levels or another exemption applies. Some listed substances may occur naturally in the environment or may be present in trace amounts in ingredients or materials used in consumer products.

The presence of a Proposition 65 warning does not, by itself, mean that a product violates federal safety requirements. Instead, the warning is intended to provide California consumers with information about potential exposure to chemicals identified by the State of California as causing cancer, birth defects, or other reproductive harm.

WARNING: Certain Skincare products may expose you to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. Where required, the applicable product page, label, packaging, or checkout notice will provide the Proposition 65 warning associated with that product. What Is California Proposition 65?

California Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a California law that requires businesses subject to the law to provide clear and reasonable warnings before knowingly and intentionally exposing individuals to chemicals identified by the State of California as causing cancer, birth defects, or other reproductive harm, unless an applicable exemption applies.

The Proposition 65 list includes a wide range of naturally occurring and synthetic chemicals that may be found in consumer products, foods, household products, manufacturing materials, or the environment. The list is maintained and updated by California's Office of Environmental Health Hazard Assessment (OEHHA).

Proposition 65 is primarily a right-to-know and disclosure law. It does not automatically prohibit the manufacture or sale of a consumer product simply because a listed chemical is present. Instead, businesses subject to the law must determine whether an exposure requires a warning based on applicable Proposition 65 requirements and exposure levels.

Does a Proposition 65 Warning Mean a Product Is Unsafe?

Not necessarily.

A Proposition 65 warning indicates that a business has determined that use of or exposure to a product may result in exposure to one or more chemicals included on California's Proposition 65 list at a level for which a warning is required or that the business has otherwise chosen to provide an applicable warning.

California establishes certain “safe harbor” exposure levels for listed chemicals. These include No Significant Risk Levels for chemicals listed as causing cancer and Maximum Allowable Dose Levels for chemicals listed as causing reproductive harm. When an exposure falls at or below an applicable safe harbor level, a Proposition 65 warning generally is not required.

Because Proposition 65 has its own warning requirements and exposure standards, a Proposition 65 warning should not automatically be interpreted as a determination that a skincare or cosmetic product is unsafe when used as directed.

Many everyday consumer products sold in California may display Proposition 65 warnings when applicable. Oliaskin provides Proposition 65 notices where we determine they are required under California law.

Why Can Skincare Products Contain Trace Levels of Listed Chemicals?

Skincare products may contain ingredients derived from plants, minerals, clays, botanical extracts, oils, pigments, water, and other naturally or commercially sourced materials.

Some naturally sourced ingredients can contain extremely small amounts of elements or compounds that occur naturally in soil, water, air, or the broader environment.

For example, botanical ingredients may absorb naturally occurring minerals from the soil and water in which plants are grown. Mineral-based ingredients, clays, pigments, and other naturally derived raw materials may also contain trace amounts of naturally occurring elements.

Certain Proposition 65-listed chemicals may therefore occur in trace amounts in raw materials without being intentionally added to a finished skincare formula.

The presence of a listed chemical alone does not determine whether a Proposition 65 warning is required. The law generally focuses on the level of exposure resulting from use of the product, and businesses must assess whether an applicable exposure falls within or above relevant Proposition 65 thresholds or exemptions.

Our Commitment to Quality

Quality, transparency, and responsible product development are important parts of the Oliaskin approach.

We work with qualified manufacturing and supply partners and maintain quality-control practices designed to support the identity, consistency, quality, and integrity of our skincare products.

Depending on the product, ingredient, and applicable manufacturing requirements, quality procedures may include:

  • Ingredient and raw-material review
  • Ingredient identity verification
  • Purity and quality assessments
  • Microbiological testing
  • Heavy metal analysis where applicable
  • Finished-product quality assessments
  • Packaging and product integrity evaluations
  • Review of product specifications and documentation

We also review ingredient and product information to help determine whether additional disclosures, labeling, or Proposition 65 warnings may be appropriate or required for products offered to California consumers.

When a Proposition 65 warning applies to a particular Oliaskin product, the warning may appear on the product page, product label, packaging, or another location where it can be provided before exposure or purchase as required by applicable regulations.

Current California regulations provide specific requirements for consumer-product warnings, including the content and placement of qualifying warnings. Certain warning formats require identification of at least one listed chemical associated with the relevant exposure.

Providing a Proposition 65 warning is part of our commitment to transparency and regulatory compliance and should not be interpreted as a statement that the product has been determined to be unsafe.
